Terms of Service

If you are a registered Member (“Member”) of the Cold Regions Living Shoreline Community of Practice (“CRLS CoP”), you are deemed to have read and accepted the Terms and Conditions (“Terms”). Please read the information below before you start to use the CRLS CoP. GOAL

The goal of the CRLS CoP is to be an online resource for practitioners to develop, support and steward the effective use of living shoreline ideas and principles in a temperate North American climate. The Terms below provide a framework to ensure everyone who visits and uses the site has a great experience, and feels safe and respected during their interactions with others via the website.

SCOPE AND PURPOSE OF THIS DISCLAIMER

This disclaimer governs your use of the CRLS CoP. By using the website located at www.ccadaptation.ca/crlscop (and the main CoP site: www.ccadaptaiton.ca), you agree to the Terms and accept this disclaimer in full. If you disagree with any part of this disclaimer, do not use the website, as that condition prohibits you from doing so.

CRI reserves the right to modify these terms at any time, and thus, you should check for changes before proceeding to utilize the services and content of the CRLS CoP. By using this site after changes have been made to this document, you agree to accept those changes, whether or not you have reviewed them.

RIGHTS TO INFORMATION PUBLISHED

Many of the materials on this site are protected by copyright and intellectual property laws. You may not reproduce this material on your personal website, blog, social network, or any other online resource without the written permission of the material's author.

You may print, copy or download the Content provided always that:

  • The third party responsible for creating the content is the acknowledged source;
  • All titles credits and URLs are included; and
  • You comply with any legal notice contained in the content.

The CRLS CoP includes links to external sites. These links are provided for your convenience only. CRI is not responsible for the availability or content of these other websites or any products or services available from them.

You should be aware that your use of such other websites may be subject to additional terms and conditions imposed by the owners of those websites. Your dealings with such third parties are between you and the third party, and CRI accepts no liability as a result of you accessing such websites.

USER-GENERATED MATERIAL

Here, the term "user-generated material" refers to any information, content, or other media uploaded, posted, emailed, submitted, or otherwise communicated to the CRLS CoP by the Members. By sharing material for publication in the CRLS CoP, you hereby confirm that it is:

  • Not offensive or obscene;
  • Not in any way illegal or infringing upon any law or any person’s rights; and it is
  • Either your own work or work clear of third-party copyright. That is, you have obtained permission from the copyright holder(s) to publish their material on the CRLS CoP.

 

In relation to any content which you upload, you grant CRI a non-exclusive royalty free license to include such content on the CRLS CoP, so that it can be downloaded by Members and used and exploited as they see fit, subject to them respecting any reasonable legal notice which you may place on such content.

DISCUSSION FORUMS

The discussion forums are provided as a place for Members to report information, seek advice and share ideas. As in a real community, forum users are asked to respect others and their rights. In order to provide forum users with general support and advice in relation to their use of the discussion forums, and for security and abuse-management reasons, CRI reserve the right to:

  • Access and monitor the use of discussion forums and any messages posted on them; and
  • Take whatever other steps we consider are necessary to protect our forum users, including editing or removing any messages or suspending or discontinuing any discussion forums.

 

CRI may not monitor every message or he conduct of every forum user. The Facilitator will access the discussion forums from time to time in order to help ensure that forum users are adhering to this discussion forum policy.

THE ACTIONS AND OPINIONS OF OTHER USERS

CRI encourages the free expression of ideas and opinions as long as they are responsible, free of insult, respectful of others, do not make public accusations related to specific projects, corporations, individuals, or contracts, and conform to the site purpose. The CRLS CoP discussions are open forums that reflect the views and experiences of the individual participants and do not represent the opinion or policy of CRI.

The CRLS CoP is managed by a Facilitator who reserves the right to edit, refuse to post, or remove any information or links, in whole or in part, that does not follow the guidelines below or are in violation of applicable law, without notice to you.

As part of the Terms for the CRLS CoP, you agree to NOT upload, post, email or otherwise send or knowingly receive any content which:

  • Is unlawful, illegal, fraudulent, offensive, threatening, abusive, harassing, tortuous, indecent, obscene, defamatory, invasive of another's privacy, or discriminatory whether racially, ethnically, sexually, religiously or otherwise, or which may incite or instruct any person or organization to undertake such activities;
  • Contains viruses, Trojan horses, worms, time bombs or any similar component likely to cause harm;
  • Contains forged headers or manipulated identifiers in order to disguise the origins of any content;
  • Infringes our legal rights or any other Member, or any other person or organization; or
  • Passes you off as, or in which you impersonate, any other person or entity, misrepresenting yourself and your connection with a third party in any way.

 

ACCESS AND AVAILABILITY

The CRLS CoP reserves the right to close a Member account without notice if use of that account appears to breach these Terms, or if attempted communications by the CRLS CoP facilitator remain unanswered. Where an account is closed, the Facilitator may, at their discretion, inform the Member of the reason by email.

CRI reserves the right to withdraw access to all or any part of the CRLS CoP for periods of time in order to modify content, scheduled or emergency maintenance and other purposes without notice to you.

Any content or other data residing on the CRLS CoP may be deleted, altered, moved or transferred at any time for any reason at the Facilitator’s sole discretion without notice and without liability to you or any third party.

LIMITED LIABILITY

CRI accepts no responsibility for any loss or harm incurred from the use of this website or any of its information or content. 

REGISTRATION AND USE OF YOUR DATA

In order to register as a Member you must have a valid email address. When registering as a Member, you agree to provide accurate, up-to-date and complete information about yourself, as prompted by the CRLS CoP.

When you successfully register as a Member you will create a username and password.  You are responsible for keeping your password confidential and shall take all necessary steps to ensure that it is kept secure and not disclosed to any other person.

If you know or suspect that your password has been disclosed to any other person you must contact the CRLS CoP Facilitator immediately to change your password. Please note that you are responsible for all activities that occur under your password.

FEES

You acknowledge that the CRLS CoP reserves the right to charge for access to www.ccadaptation.ca and www.ccadaptation.ca/crlscop to change its fees from time to time in its discretion.

NOTICES

The Facilitator may provide you with notices regarding the CRLS CoP by regular email or postings to this website.

LEGAL JURISDICTION

The federal laws of Canada shall otherwise govern your use of the site where these terms and conditions are not clear or incomplete, and you hereby agree to submit to the exclusive jurisdiction of the Canadian Federal and Provincial court system.
